Art. 4 – Terms of Sale

  • 4.1 Eligibility and ordering
    You can order as a guest or a registered user. To place an order you need an e-mail address, and you may need to set your browser to accept both cookies and pop-ups in order to be able to use all the functionalities of the website, which includes adding products to your shopping cart and submitting your order.All prices indicated are EUR amounts and include value added tax. Orders and deliveries are possible to Euro countries (except from Scandinavian countries), The United Kingdom and Ireland and Switzerland. If Sockwell.eu is not able to execute an order, Sockwell.eu will inform you as quickly as possible.When you submit an order, we will send you an (automatic) email acknowledging receipt of your order. This does not mean that we have accepted your order. Our acceptance of the order takes place when the products are shipped to you – we will send you an email confirming that the products have been shipped.Products on the website have stock and are ready to sent. Any sizes out of stock aren’t visible in the drop-down menu to select your size. We may have stock issues from customers ordering products the same time or during an undesirable failure in our stock system. When we are unable to ship an item already ordered, we will contact you to offer an alternative product or we may cancel that part of your order and you will be reimbursed or not charged accordingly, depending on your payment method. We work hard to keep our stock levels as accurate as possible. Occasionally, errors may occur. If the products you are looking for are sold out you can contact us or you may wish to check availability with a Sockwell retailer through our Store Locator.Please note that we cannot make or accept any changes (address, size, colour) once your order has been placed.

    Fulfilment of all orders on Sockwell.eu is subject to availability. We explicitly reserve the right not to accept your order for any reason. We also reserve the right to cancel an order by written notice to you in the following situations, without being liable for any damages or costs other than repayment of any amount received from you in relation to the order we have cancelled:
    – The product is not available
    – Your billing information is incorrect or not verifiable
    – Your order is flagged up by our security systems as an unusual order or an order susceptible of fraud
    – If applicable your bank transfer payment is not received within 5 business days after the order confirmation
    – We could not deliver to the address provided by you. Make sure that your address details are correct before confirm your order
    – Due to circumstances or events beyond our control

  • 4.2 Prices and Payment
    The total price specified in the final checkout screen includes tax and shipping costs. This price will be recorded in the order confirmation.
    The prices of the products will be as displayed on the website. Prices may change from time to time, but changes will not affect any order which we have confirmed in the order confirmation.You can pay for the products by Debit Card (Maestro), PayPal and by other means as may be applicable in your country (iDeal, Sofort, GiroPay, MisterCash/Bancontact).If you have a promotion code, please enter it in the shopping bag page in the ‘Discount code’ field and click on ‘Apply Coupon’. Please check the expiry date of your promotion code before using it. Please note that you cannot use more than one promotion code for the same order. Please note that if using promotion codes on products on SALE, the promotion code might not be applicable. Every promotion code is valid for one time use only, unless stated differently.During the payment process Sockwell.eu may perform credit checks. Based on the outcome thereof Sockwell.eu may change, adjust or decline an order and/or the selected payment method. In most cases Sockwell.eu will offer you the option to select a different payment method.

Art. 5 – Delivery and Returns

  • 5.1 Delivery
    We offer free delivery, so we do not charge for shipping unless stated otherwise. We don’t offer “Express Delivery”. As a rule, delivery time is 2 to 5 working days after shipping the order. When you have ordered multiple products with us, it is possible that we sent it in several packages. Exceeding the agreed delivery times does not entitle the customer to compensation, dissolution of the agreement or non-fulfilment of any obligation that may arise from this or from any other related agreement.The product must be delivered to the customer no later than 30 days after ordering. If this does not happen, the customer can cancel the purchase. This does not apply if the parties have agreed a different delivery period.If the delivered products have obvious material or production defects, including damage caused by transport, please notify us of such defects immediately by email or phone. Not doing so will not affect your legal rights.
  • 5.2 Return and cancellation
    Your right of withdrawal; we do everything we can to deliver a perfect product. If the ordered item(s) does not meet your expectations, you can return it within 14 calendar days after the day on which the product(s) come into your physical possession (or into the possession of a third party other than the carrier and indicated by you).We also remind you that under applicable law, we are responsible for providing products that are in conformity with the contract. You may be entitled to some money back or to a repair or replacement of the product in question.To exercise your cancellation right, you need to inform us of your intention to return the product(s). Use our (online) cancellation form we have provided with the products (back of the package slip) or sent an email to info@sockwell.eu. Please provide your name, home address , details of the order and phone and/or email address. To help us serve you better please make sure that you fully complete the returns form. It is important that you state the reason for returning each item you return to us. Stick the returns label to the box and if using the box that we sent to you, make sure that the return label covers the original label used to ship the parcel to you.If you cancel your order, we will reimburse you all payments received from you, including the costs of standard delivery (if applicable), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to return the products. We may however withhold reimbursement until we have received the products back or until you have supplied evidence of having sent back the products, whichever is the earliest.Please note that products that you have bought online cannot be returned to Sockwell stores in your local area and vice versa. Please make sure that you do not have returns from multiple orders in one parcel to ensure that you get your refund as quickly as possible.

    Returned products must be returned in the same condition as they were sent. We will not accept or refund products that have been worn or washed. If the products have deteriorated due to a more extensive use, we reserve the right to send the product back to the shipper.

Art. 6 – Liability

  • 6.1 Liability
    Sockwell.eu accepts no liability for any damage resulting from the use of Sockwell.eu products.Any liability of Sockwell.eu and of the personnel and products of Sockwell.eu for all damage, of whatever nature, directly or indirectly, including trading loss, consequential damage, damage to movable or immovable property or to persons, is explicitly excluded. Sockwell.eu is also not liable for the damage caused by third parties in the execution of the agreement.Any liability of Sockwell.eu towards the buyer is in any case limited to at most the invoice amount that the buyer owes to Sockwell under the relevant agreement.
